As of January 31, 2012 ALL EMPLOYEES, including salaried, must have the correct "Notice and Acknowledgement" form completed.

New York State will be assessing a $50 fine to employers for each employee that does not have documentation.

This is now an annual requirement.  Every employee must complete a new form by January 31st of each year and at any time during the year that they are given a raise in pay.  The original must be retained by the employer and a copy given to the employee.

It is our understanding at this time that this is one of the items on New York State Department of Labor audits to be checked in 2012.
